Visto
Que en el expediente Nº 2024-00039193 Jefatura de Personal de esta Municipalidad, se declara incompetente para que personal de la misma lleve adelante el proyecto “PROGRAMA ESPACIO DE PRIMERA INFANCIA”, por no contar con disponibilidad de personal idóneo en la materia y/ u operadores vinculados a las actividades que promueve el proyecto y;
Considerando
Que el artículo 148 último párrafo del Decreto-Ley 6769/58 -LOM-, establece que cuando las Municipalidades carezcan de oficinas técnicas a cargo de profesionales en obras públicas o teniéndola organizada, ésta se declare incompetente, el Departamento Ejecutivo podrá contratar directamente la realización de los trabajos.
Que, si bien dicha disposición es aplicable para las obras públicas, la doctrina del HTC en oportunidad de la Ley 11757, la hizo extensiva para la contratación bajo la modalidad de contrato de obra a otros profesionales, a fin de justificar la misma.
Que, bajo ese marco normativo, la doctrina del Honorable Tribunal de Cuentas, ha considerado factible la contratación de personal bajo la modalidad de “locación de obra” con carácter excepcional, siempre que no se cuente con el personal especializado o el existente se declare incompetente.
Que es intención de este Poder Ejecutivo brindar un servicio para el bienestar de la comunidad;
Por ello,EL INTENDENTE MUNICIPAL, en uso de sus atribuciones,
D E C R E T A:
ARTÍCULO 1º: Reconózcase, desde el 01/01/2025 hasta el 31/03/2025 que se encuentra vigente el proyecto “PROGRAMA ESPACIO DE PRIMERA INFANCIA”, la declaración de incompetencia formulada por la Jefatura de Personal a través del expediente precedentemente citado, con relación a la ejecución de las tareas que se denuncian.
